The website provides an online recruitment and information service, where both recruiters can advertise jobs and associated information, and candidates can search for positions and apply on line. Please note that when you respond to a recruiter’s advertisement, or a candidate’s CV you are acting directly between each other, and any contracts or arrangements which may arise are between the candidate and recruiter direct. Thrilling Media Ltd, its directors, owners, shareholders, employees, agents or any other associated company relating to this website shall not be held responsible or be liable for any situation arising out of an arrangement/contract formed between candidate and/or recruiter.
 
You agree that you will not (or authorise any one else to) use the Website or the Services to knowingly or recklessly transmit or receive material which is offensive, threatening, defamatory, obscene, abusive or in breach of confidence or intellectual property right (including copyright), or which violates any applicable law or regulation or code, or which makes excessive demands on bandwidth, or contains virus, malicious code, worms or any other which may impair or harm our computer systems or those of a third party or hosting company. "Candidate" means the person or persons seeking employment, uploading CV or building a CV online. "Customer" means any person, company, organisation, firm or body which purchases services. Some services provided are only available for those who register. "Services" means all products (recruitment, news posting, tenders, email alerts, and others as added) and services made available by us on this website. "Website" means justcareers.co.uk, or any other website owned and managed by Thrilling Media Ltd.
 
Advertiser
 
This means the Employer or organisation placing, or authorised to place, an advertisement on the site. This can be the Advertiser or its agent, whichever is acting as the principle.

Advertisement

This means recruitment advertisement, information supplied in news story, tenders, information pack, banners, buttons, employer buttons, job of the week or top job, featured employer links, online job vacancies.

You may not promote this site in any publicity and may not utilise or copy any of the functions promoted herewith. Though every effort will be, and has been, made to protect the data, due to the nature of the Internet, we cannot guarantee that unauthorised third parties will not be able to access information through illegal methods. The site and its owners understand that advertisers have obtained consent from any person shown or advertised in their news story, advertisement or information posting. If the advertiser fails to obtain the necessary consent, Thrilling Media Ltd and the website, and all associated employees and agents are indemnified from any claims.
 
Maximum claims against the website
 
Should any claim arise against the website, or Thrilling Media Ltd, as a result of you using this site you agree that by accepting these terms and conditions, the total liability of the website and/or Thrilling Media is limited to the total amount paid to us by you the customer during the Contract Term for Services provided by the website, or a maximum figure of £100, whichever is the lesser. It is NOT per advertisement. By accepting the terms, you agree to this.
 
Agreement and use of site
 
Users agree to use the site lawfully. This website and Thrilling Media Ltd, and its directors, shareholders or staff do not endorse the content of any advertisement, comments, press release, information or other, provided within any profile pages or profile downloadable pack, or candidate CV.
 
Age requirements
 
This website is primarily a recruitment advertising website. All users must meet the necessary age requirements. We do not knowingly collect or publish personal information from anyone under the age for employment. No part of our website is structured to appeal to anyone under the legal working age.
 
Help
 
To utilise the site, it is your responsibility to ensure that you have the appropriate equipment and connection. Should you have any problems posting jobs we have included a help link. We will post jobs on your behalf if you require us to do so.

If we have permitted links from our site to any of your external sites, it is your responsibility for maintaining links and the content of the information on the linked site. Termination

Thrilling Media Ltd reserve the right to permanently terminate access to the services immediately for any reason without giving prior notification.
 
Advertisers
 
Authority for placing/authorising advertisementsAny customer who authorises advertising on this site is understood to have responsibility for advertising. To this end, this will form a contract between yourselves and the website, and its owners, Thrilling Media Ltd. An "order" is any order received by us (in any format). The Contract Term is the full term specified at the time of placing the order.
 
Pricing
 
Prices are confidential. They may not be disclosed by the Customer to any other party.
 
Duration of job posting
 
A job posted on this site will remain live for the duration specified by the customer's selected employer plan when submitting a job or as agreed in any special promotion provided by Thrilling Media Ltd. No extensions to the date will be made. Any further extensions required will be deemed as a new posting and will be charged accordingly. Jobs posted by customers in addition to the agreed number of jobs per month will be charged at a price per job basis, unless otherwise agreed beforehand by Thrilling Media Ltd.

Payments
 
If any Services are not used within the time period at the time of purchasing, services may not be carried over into any subsequent period without our prior written consent. It is the customers responsibility to ensure they fully utilise the services available within the given time period. Customers are still held responsible for payment for any unused Services, and no refund will be made by the website, its owners, shareholders, directors, agents or associated companies. Prices exclude VAT. VAT (where applicable) will be charged at prevailing rates. Payment due at time of registration, on submission of invoice, or 28 days from date of invoice, whichever has been agreed at time of "contract". Late payment will result in suspension of services without prior notification. Interest will be charged at 3% above Barclay’s Bank plc base rate per day.
 
Cancellation of need to advertise/promote services or company

The Customer may terminate the provision of Services. At least 30 days notice is required, and must be in the form of a letter, on headed paper. In such circumstances a cancellation fee may be charged to suspend services. The cancellation fee may be 20% of the overall contract value, or other, as is seen applicable by Thrilling Media Ltd. No negotiation will be entered into. We will provide a cost implication prior to suspending services in such circumstances. We reserve the right to cancel, delete or suspend services provided to customers if we find that any breach of these terms and conditions have been made or if the customers becomes insolvent, ceases trading, goes into liquidation and/or administration.

Employment agencies and employment businesses
 
Employment Agencies Act 1973
 
Employment agencies or employment businesses (as defined by the Employment Agencies Act 1973) are responsible to ensure that advertisements placed on the website are fully compliant with your obligations under the Employment Agencies Act 1973 and Conduct of Employment Agencies and Employment Businesses Regulations 2004. By using this site and agreeing to the terms and conditions you agree that your advertisements posted on this site, and you, comply with the Act and the regulations.
 
Rules of using the site
 
When posting vacancies, news stories, tenders or other documentation or information on our website, the format and its content must comply with the site requirements. At our discretion, and without notification and without us incurring any liability to you, we may remove information which does not comply with our rules. Our rules may change without notification to you. Please refer to the rules on a regular basis. Our site rules include:
No promotion of any job opportunities or vacancies in any news story, if the site supports news stories.
No knowing duplication of job vacancies, unless paid for each insertion.
No promotion of products or services allowed in the news stories, tenders, announcements or job advertisements.
No links to your website jobs page or any other job website allowed unless prior written agreement has been obtained.
No repeating use of keywords in job descriptions to aid "search" facility.
No promotion of "business opportunities".

If we find there has been a breach of these rules, you agree that Thrilling Media and this website will suspend your access to the site and also will withdraw such items, without incurring any liabilities. You also agree that Thrilling Media may edit, reject or suspend such items without incurring liabilities and without prior consultation with yourselves. You also agree that Thrilling Media Ltd reserves the right to charge a fee to yourselves for such a breach of site rules.

Discrimination
 
No advertisements which discriminate on grounds of sex, race, age, gender, disability. No content within any articles, news stories, information or any part of the website which are offensive, indecent, untrue or defamatory. Should you advertise or publish any such item you agree to accept all responsibility for your actions, and agree that Thrilling Media Ltd and the website is not held responsible for any actions that may arise.
 
If we believe that an advertisement may be discriminatory, we may amend the advertisement or remove it from the site. Should this be necessary we will not make any refund of amounts paid or due to be paid in respect of the posting. Your actions will be seen as a "breaking of the rules". We reserve the right to reject, edit or suspend News Stories and other content as we feel appropriate without prior consultation with yourselves.
 
Advertisements which appear to discriminate on grounds of sex, race or disability are illegal and may result in proceedings being taken against both the advertiser and the publisher. It is your responsibility, as an advertiser, to ensure your advertisement and information published content is legal. By using and advertising on this site you agree that you have taken necessary steps to ensure your advertisement/information published is legal and you will be held solely liable for any actions which may arise. You indemnify ourselves accordingly.

Response to advertisements/information/work permits
 
You agree to deal fairly and professionally with individuals who may respond to an advertisement. You agree not to bring this website or its owners into disrepute. You will indemnify us from and against any claim brought by an individual against this website and Thrilling Media Ltd arising from your breach of this obligation or any other of these terms and conditions. It is your responsibility to check the responses to any advertisements. We do not guarantee that any response made to your advertisement or information you provide on the site is a genuine response. It is your responsibility to undertake any checks and procedures necessary to ensure that candidates are suitable for the job advertised with the required qualifications. This includes, but is not limited to, any Criminal Records Bureau (CRB Checks) and Work Permits.
 
Refusal of advertisements and other information/news stories etc
 
We reserve the right to refuse advertisements or information, news posting, stories or other.
 
News stories, if allowed on the site, may only be posted once. Continual posting, or re-editting and re-submitting news stories is not acceptable, and will be deemed as "breaking the rules". We may restrict your access to the site without providing compensation and may withdraw or cancel any news story we feel appropriate without prior consultation.
 
Candidate database
 
As and when we may provide access to a searchable candidate database of job seekers. This information is the copyright of Thrilling Media Ltd. By granting you the customer access to any databases, whether job seeker, site survey or other, you agree that the information supplied is "as is" and that the information and other intellectual property rights are the sole copyright and are fully owned by Thrilling Media Ltd. You also acknowledge that you do not acquire any rights in the database or of its content, and that your retention and use of the database, and its content, is governed by our terms and conditions. Employment agencies or employment businesses must ensure that the use of information from our candidate database complies with your obligations under the Act and the various regulations made under it, together with any applicable guidelines.
 
The material you are entitled to receive from the candidate database is determined by the product you have purchased from us, or by any special offers as and when offered by Thrilling Media Ltd.
 
On receipt of the information, you are entitled to use the information only in connection with your own recruitment needs. You may use the information about individuals contained within the database to contact them in relation to the specific job vacancy. You agree that you comply with the Data Protection Act 1998, and all other and subsequent legislation and regulations. You may not supply, sell or license material from the database or copy it and supply to any other third party, including any individual or member of your group of companies. You agree not to contact any individual who has registered details on our website for any other reason, only for the job which you have advertised on the site. You may not download the database through any "hacking" or automated process. Once you have used the database, you agree to destroy all candidate-related information, eg CVs if and when required. It is your responsibility to deal fairly and professionally with individuals, and agree to not do anything which will bring the site or it owners into disrepute. You agree to indemnify ourselves against any claim brought against ourselves arising from your breach of this obligation.

Online advertising
 
These terms and conditions apply to all advertising material and information promoted or published on this site and are subject to being accepted by Thrilling Media Ltd for display on this, or any of our other web sites. By placing an advertisement or posting information, you accept these terms and conditions. All advertisements are accepted subject to space being available. The publisher reserves the right to omit or suspend an advertisement/published article at any time. No claims on the part of the advertiser for damages or breach of contract shall arise.
 
We must receive the advertisement/news articles content in an acceptable format in order to fulfil advertising agreement. It is your responsibility to ensure we receive relevant information in the necessary format.
 
Alterations of order
 
Where possible we will endeavour to make alterations to any order that you have mistakenly processed. However, we can not be held for such mistakes, and may need to charge a fee relating to such to cancel any posting. To cancel or alter your order you must inform us, by fax or email as soon as possible.
 
Content of advertisements/information posted
 
The principle (advertiser or agent) is responsible for the content of the advertisement or articles submitted for inclusion on the website. You agree to the terms and conditions of use of this site, and agree that all information contained within advertisements and any necessary articles comply with all relevant legislation, and codes of practice. You understand you are fully responsible for the content of your advertisements and information posted on the site, including, but not limited to, news stories, tenders etc. All content must comply with all relevant codes of practice and legislation. You agree to indemnify ourselves against any claim should your content infringe the intellectual property rights, or is defamatory, offensive, discriminatory or other. If you are an employment agency or an employment business (as defined by the Employment Agencies Act 1973) you are responsible to ensure the advertisements and information posted on the website comply with the Conduct of Employment Agencies and Employment Businesses Regulations 2004.
 
Any response received from advertisements or information posted is your responsibility – it is your requirement to deal with such response.

Advertisers agree that a credit sold for job posting can only be used by you. It can not be sold or used by any other advertiser. If the advertiser goes into liquidation, the order is void.
 
Advertisers agree that a banner, button, link or other will only be used by that advertiser. It can not be sold or used by any other advertiser. If the advertiser goes into liquidation, the order is void.
 
Invoicing and credit card payments
 
Advertisers may need to pay via invoice, or credit card. We reserve the right to withdraw methods of payment at any time. Your credit card is only charged when you purchase related goods on the site, and no information is held by ourselves. Advertisers agree that the website and Thrilling Media Ltd is not liable for loss of candidates CVs or any other material that has been supplied by candidates. Advertisers also agree that we are not liable for any failure to secure candidates for a vacancy or any subsequent loss, whether caused by our negligence or not.
 
Job seekers
 
Job seekers are not required to pay anything. The services provided to jobseekers are completely free
 
Matching CVs and Job Advertisements
 
CVs and job advertisements contained on the site are provided by candidates and by prospective employers and their agents. They are not reviewed by us. As a result, we cannot vouch for the accuracy in either. We accept no responsibility or liability for the contents of CVs or advertisements and expect candidates and prospective employers to carry out such verification procedures as are customary and prudent in the circumstances.
 
Data protection
 
Our use of CVs and other personal information supplied by users of this site is governed by our privacy policy. Your CV will not be passed to any third party; Thrilling Media may however use your CV for its own recruitment consultancy. By submitting your CV you agree to this. 
 
Liability
 
Our liability, and the liability of our third party suppliers, for any loss or damage suffered by you as the result of your use of this site is limited to your actual direct damages and, except in the case of fraud, excludes any loss of future earnings, profit or prospects or any consequential or speculative loss. As required by law, this exclusion does not extend to death or personal injury caused by our negligence.
Governing law
 
These terms and conditions shall be interpreted in accordance with English law and all disputes shall be decided by the English courts.
